MarketsGuide Terms of Service
Effective Date: 16 April 2026
These Terms of Service govern your access to and use of MarketsGuide, including the website https://www.marketsguide.com.au, any related subdomains, authenticated areas, organiser tools, and related services we make available from time to time (collectively, the Service).
The Service is operated by NARADOO, JEERISH (ABN 82 513 864 085), referred to in these Terms as MarketsGuide, we, us, or our.
By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
1. About MarketsGuide
MarketsGuide is an Australian market directory and related software service designed to help people discover markets, save favourites, follow listings, and receive updates about markets they choose to follow.
MarketsGuide also includes tools that allow authorised market organisers to claim and manage listings, including editing listing information, schedules, photos, and certain market update settings.
Some features may be added, changed, removed, or released later, including vendor-related features, paid subscriptions, and payment functionality. If additional terms apply to a specific feature, subscription, or payment flow, those additional terms will also apply.
2. Eligibility
You must be at least 13 years old to use the Service.
If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian.
If you use the Service on behalf of a business, organisation, market, or other entity, you represent that you have authority to bind that entity to these Terms.
3. Your Use of the Service
You may browse the public directory without an account.
If you create an account, you may be able to:
- save favourite markets
- follow markets
- manage notification preferences
- access other account-based features we make available from time to time
You must ensure that the information you provide is accurate and kept reasonably up to date.
You are responsible for all activity that occurs under your account and for keeping your login credentials secure.
You must notify us promptly if you believe your account has been accessed without permission.
4. Organiser Accounts and Claimed Listings
If you claim a market listing, create a listing, or manage a listing through the organiser tools, you represent and warrant that:
- you are authorised to act on behalf of that market or organising entity
- the information you submit is accurate, current, and not misleading
- you have the right to upload and use any content you provide, including photos, logos, schedules, and documents
- your listing content and conduct comply with all applicable laws
We may request information to verify your authority to claim or manage a listing.
We may approve, reject, suspend, edit, unpublish, or remove any listing, claim, or organiser account at our discretion, including where we reasonably believe information is inaccurate, misleading, unauthorised, unlawful, or harmful to the integrity of the Service.
5. Listing Information and Platform Role
MarketsGuide is a directory and software platform. We are not the organiser of listed markets unless expressly stated.
We do not guarantee that any listing, market date, location, schedule, stallholder attendance, cancellation status, weather update, amenity, application process, or other information on the Service is complete, accurate, or current.
Markets change. Organisers may update, fail to update, or incorrectly update information. We may also compile listing information from public sources and from organiser submissions.
You are responsible for making your own enquiries before attending a market, relying on a listing, or making any commercial decision based on information published through the Service.
6. Acceptable Use
You must not:
- use the Service for any unlawful purpose
- submit false, misleading, deceptive, or unauthorised information
- impersonate any person, business, or market organiser
- interfere with, disrupt, or compromise the security or operation of the Service
- upload malicious code, spam, or harmful material
- harass, threaten, abuse, or defame other users or organisers
- use automated means to access, scrape, harvest, copy, or extract data from the Service at scale without our prior written consent
- republish, mirror, or commercially reuse directory content without our prior written consent
- use content from the Service to train, fine-tune, or otherwise develop third-party machine learning or AI models without our prior written consent
General browsing, normal indexing by search engines in accordance with our published crawling preferences, and ordinary linking to public pages are permitted unless we state otherwise.
7. Content and Intellectual Property
All rights, title, and interest in the Service, including its design, layout, branding, software, compilation, and original content, are owned by us or our licensors unless otherwise stated.
You must not copy, reproduce, modify, distribute, sell, license, or exploit any part of the Service except as permitted by law or by our written permission.
If you submit content to the Service, including listing information, photos, logos, schedules, descriptions, updates, or other materials, you retain ownership of your content. However, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, format, display, publish, and communicate that content for the purpose of operating, promoting, improving, and providing the Service.
You warrant that you have all rights necessary to submit that content and grant that licence.
8. Notifications and Communications
If you create an account or follow a market, you may receive service-related emails or notifications connected with your account or the features you have chosen to use, including market updates, cancellations, or similar notices.
You are responsible for ensuring your email address and notification preferences are current.
We do not guarantee delivery of any email or notification and are not responsible for missed or delayed notices caused by third-party providers, spam filtering, technical issues, or inaccurate contact details.
If we later offer marketing communications, you will be able to unsubscribe from those communications where required by law. Service and account-related communications may still be sent where necessary to operate the Service.
9. Future Paid Features
We may introduce paid features, subscriptions, profiles, vendor tools, organiser tools, application workflows, and payment functionality in the future.
If we do, we may publish additional commercial terms covering matters such as pricing, billing cycles, renewal, cancellation, refunds, tax, payout arrangements, and payment processor requirements. Those additional terms will apply to the relevant paid features.
10. Suspension, Removal, and Termination
We may suspend, restrict, or terminate your access to all or part of the Service at any time if:
- you breach these Terms
- we believe your use creates legal, security, reputational, or operational risk
- we believe a listing or account is misleading, fraudulent, or unauthorised
- we discontinue a feature or part of the Service
You may stop using the Service at any time.
Account deletion tools may be made available through the Service. Deletion of your account may remove access to account-based features and may also result in deletion or de-identification of associated data, subject to any information we are required or permitted to retain for legal, security, fraud prevention, backup, or operational reasons.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis.
We do not guarantee that:
- the Service will be uninterrupted, secure, or error-free
- listings will be accurate or complete
- a market will proceed as advertised
- any feature will continue to be available
- the Service will meet your requirements or expectations
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
12. Limitation of Liability
To the maximum extent permitted by law:
- we are not liable for any indirect, incidental, special, exemplary, or consequential loss
- we are not liable for loss of profits, revenue, opportunity, goodwill, data, or business interruption
- we are not liable for loss or damage arising from reliance on listings, organiser content, public source information, market cancellations, changed schedules, third-party conduct, or use of third-party services
Where liability cannot be excluded, our liability is limited to the minimum extent permitted by law.
13. Indemnity
You indemnify us and hold us harmless against any claim, liability, loss, damage, cost, or expense, including reasonable legal costs, arising out of or connected with:
- your breach of these Terms
- your misuse of the Service
- your content
- your infringement of any third-party rights
- your unauthorised or misleading claim to represent a market or business
This clause applies only to the extent permitted by law.
14. Third-Party Services and Links
The Service may rely on or link to third-party services, websites, login providers, analytics services, email providers, form providers, hosting providers, and payment providers.
We are not responsible for third-party services, their availability, or their content. Your use of third-party services may be subject to their own terms and privacy policies.
15. Changes to the Service or These Terms
We may change the Service or these Terms from time to time.
If we update these Terms, we will publish the updated version on the Service and update the effective date. Your continued use of the Service after the updated Terms take effect means you accept the revised Terms.
16. Governing Law
These Terms are governed by the laws of Queensland, Australia.
You submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
